Procurement teams: send us your standard terms and we will tell you plainly which clauses we can accept.
In full
1. Quotes
Quotes are valid for 30 days and include a 48-hour hold on the specific stock quoted. Prices are in US dollars and exclude sales tax. Freight is quoted separately and itemised. A quote is an offer to supply the graded units identified in it, not a general price list.
2. Grading
Grades are as defined on our grades page and are assigned by our graders before wash. Each unit carries a unit number and a photographed grade record. If a delivered container does not match the grade quoted, notify us within 14 days with photographs and we will collect and replace or credit it at our cost.
3. Suitability and compatibility
We will check chemical compatibility on request when you supply a safety data sheet, and we do so carefully. That check is advice, not a warranty of fitness for your process. You remain responsible for confirming that a container, its gasket material and its rating are appropriate for your specific application, storage conditions and regulatory environment.
We do not sell containers with unknown prior contents, and we will decline an order where we believe the container is unsuitable for the stated use.
4. Payment
Payment is due before dispatch unless you hold approved net-30 terms. We accept ACH, check and card; card payments over $2,500 carry the processing fee. Overdue accounts accrue interest at 1.5% per month and further dispatch is suspended until cleared.
5. Delivery and risk
Risk passes on delivery to the address you nominate, or on collection at our yard. You are responsible for providing a forklift or booking liftgate service, for a safe and accessible unloading point, and for informing us of access constraints in advance. Waiting time caused by an unavailable unloading point is chargeable.
Lead times are given in good faith and are usually met. They are not guarantees, and we do not accept liability for consequential loss arising from a late delivery.
6. Returns
Unused, unfilled containers may be returned within 14 days subject to a 15% restocking charge and return freight at your cost. Containers that have held any product are not returnable for credit, though we will always buy them back as used stock at the prevailing grade price.
Where a container is not as graded, or is damaged in our delivery, there is no restocking charge and we collect at our own cost.
7. Warranty
New containers carry the manufacturer's warranty. Rebottled containers carry a 12-month warranty against bottle defect and leak failure. Reconditioned containers are warranted to be free of leaks at the point of dispatch, evidenced by the leak test record supplied. Grade C containers are sold explicitly as-is with no warranty as to condition, which is reflected in their price.
8. Regulated containers
Where a container is supplied for regulated liquid service, the periodic inspection record we supply is current at the date of dispatch. Maintaining subsequent testing under 49 CFR 178.813 is the operator's responsibility. We will remind you if the container was purchased from us and you ask us to.
9. Selling containers to us
Prices we quote for your empties are firm for 30 days and are subject to the containers grading as described. If a lot grades below its description we will photograph it and send you the revised figure before processing anything. You warrant that you have disclosed the prior contents accurately and that any regulated container has been properly emptied under 40 CFR 261.7.
10. Governing law
These terms are governed by the laws of the State of California, and the courts of the City and County of San Francisco have jurisdiction.
